What Biz Smart collects, why, and what you can ask us to do with it. Last updated 12 October 2026.
Who we are
Biz Smart is a service in Kenya that gives a business an AI assistant to answer its customers, on the business's website and on its WhatsApp number. You can reach us at hello@bizsmart.co.ke.
This page covers three groups of people:
- Visitors to this website.
- Businesses that use Biz Smart, and their staff.
- Customers of those businesses, who chat with a business's assistant.
If you visit this website
This website has no advertising and no tracking cookies. If you fill in the Get started form, we keep the name, business name, phone number, email address and message you give us, and use them only to contact you about Biz Smart.
If you type a question to the assistant on this site, your messages are kept as described under "If you chat with a business's assistant" below.
If your business uses Biz Smart
We keep:
- Account details: your name, email address and a protected (hashed) form of your password. The same for any staff you add.
- What you give the assistant to answer from: files, website pages, tables and typed answers.
- Your customers' conversations with your assistant, the leads it saves, and the questions it could not answer.
- Your plan, invoices and whether they are paid.
Payments are handled by IntaSend (M-Pesa and card). We never see or store your card number or your M-Pesa PIN.
If you chat with a business's assistant
When you message a business that uses Biz Smart, on its website or on WhatsApp, that business decides why and how your information is used. We store and process it for them. We keep:
- The messages you send and the replies you get.
- On WhatsApp: your phone number and your WhatsApp profile name, which WhatsApp sends with your message.
- On a website: a random code saved in your browser so the chat can continue when you come back. It does not identify you.
- Your name, phone number or email address, only if you give them so that the business can contact you.
The business and its staff can read these conversations and can reply to you in person. Conversations are deleted automatically 30 days after your last message. Contact details you asked a business to keep stay until that business deletes them.
How answers are produced
To write a reply, the assistant sends the conversation and the relevant parts of the business's information to an AI model run by another company. We do not use your conversations to train AI models of our own. Answers come from AI and can be wrong, so confirm anything important with the business.
Who else handles the information
We use other companies to run the service. They handle information only to provide their part:
- Hosting and database providers, which store the service and its data.
- AI model providers (such as OpenAI, Google, Groq and Anthropic), which produce the replies.
- Meta, for conversations on WhatsApp.
- IntaSend, for payments.
- An email provider, for the emails we send you.
Some of these companies store or process information outside Kenya. We do not sell personal information to anyone.
How long we keep it
- Conversations with an assistant: 30 days after the last message.
- A business's account, content, leads and invoices: for as long as the business uses Biz Smart. When a business is removed, its content, conversations and leads are deleted with it.
- Get started enquiries: until we have dealt with them, or until you ask us to delete them.
Your rights, and how to delete your data
Under Kenya's Data Protection Act, 2019 you can ask to see the personal information held about you, to have it corrected, or to have it deleted, and you can object to how it is used.
To do any of these, write to hello@bizsmart.co.ke. Tell us which business you chatted with and the phone number or email address you used, so we can find your information. We will act on it and confirm, normally within 30 days. If your request is about a business's own records, we will pass it to that business as well.
If you are unhappy with our answer, you can complain to the Office of the Data Protection Commissioner of Kenya.
Children
Biz Smart is for businesses. It is not meant for children, and we do not knowingly collect their information.
